Terms and Conditions of Use

Your use of the Exchange is governed by the following terms and conditions:

1.

The Australian Learning and teaching Council accepts no liability or responsibility for any loss or damage whatsoever suffered as a result of use of the Exchange.

2.

The ownership of and intellectual property rights in any contributions which are project material from projects funded by the Australian Learning and Teaching Council are vested in the Australian Learning and Teaching Council, as per the terms and conditions set out in pre-existing individual project Funding Agreements.

3.

Users contributing to the Exchange are bound by Creative Commons Licensing arrangements. See Rights Management Licensing Framework.

4.

In relation to any material contributed by you:

 

a.

You grant the Australian Learning and Teaching Council a permanent, irrevocable, royalty-free, non-exclusive licence to use, reproduce, modify, adapt, publish, sublicense, create derivative works from and incorporate in other works that material at any time in the future, in any form and for any purpose;

 

b.

You warrant that you are, or will be at the relevant time, entitled to deal with the intellectual property rights in the material, including any embedded third party material;

 

c.

You warrant that the receipt of the material by the Australian Learning and Teaching Council is not illegal or defamatory and will not expose the Australian Learning and Teaching Council to any civil or criminal liability, including but not limited to a warranty that the material is not misleading or deceptive or likely to mislead or deceive;

 

d.

You indemnify the Australian Learning and Teaching Council for any breach of the warranties contained in 4.b and 4.c above.

5.

Use of the Exchange is expected to be undertaken for educational, professional, personal and non-commercial purposes and in compliance with the Code of Practice Policy.

6.

The Australian Learning and Teaching Council will remove from the Exchange any contributions that do not conform to clause 5. See Content Standards: Content Removal.
